Reminder: trash cans, recycling bins, and trash must
be stored out of sight from the street.
This rule comes from City of San Marcos code and is also in our CC&R's, Article XI, paragraph (g):
All homeowners are required to adhere to the CC&R's as a condition of purchase of your home in this neighborhood. A complete copy of the CC&R's was supplied when you purchased you home and can also be viewed online. If you accidently leave your trash cans out a few days after trash pickup, the HOA is not going to fine you. At most, we will send a reminder letter after a week goes by. The cases we are most concerned about are the properties where the trash cans and trash are permanently stored out in the driveway or alongside the house visible from the street. The Homeowners Association can levy fines, such as $10.00 per day for violations. As with past due HOA fees, the HOA can, in extreme cases, put a lien on properties if the fines or fees are not paid can even force sale of the property to pay off fines or fees. Leaving trash cans out is also a violation of City of San Marcos code and you may be cited by the city.
