Trash Storage

This rule comes from City of San Marcos code and is also in our CC&R's, Article XI, paragraph (g):

All equipment, tools, trash and/or garbage containers, wood and/or storage piles shall be kept concealed from view of the other Lots, the Common Area and the adjacent streets. No exterior clothes lines or individual outdoor television or radio antennae shall be erected or maintained on the Properties other than any required for cable TV service to any Lot. No automobile overhaul or maintenance work, in the absence of an emergency, shall be performed in the Properties where it can be viewed or on adjacent streets, the interior of garages shall be kept clean, and garage doors shall be kept closed when not in use.

All homeowners are required to adhere to the CC&R's as a condition of purchase of your home in this neighborhood. A complete copy of the CC&R's was supplied when you purchased you home and can also be viewed online.

If you accidently leave your trash cans out a few days after trash pickup, the HOA is not going to fine you. At most, we will send a reminder letter after a week goes by. The cases we are most concerned about are the properties where the trash cans and trash are permanently stored out in the driveway or alongside the house visible from the street.

The Homeowners Association can levy fines, such as $10.00 per day for violations. As with past due HOA fees, the HOA can, in extreme cases, put a lien on properties if the fines or fees are not paid can even force sale of the property to pay off fines or fees.

Leaving trash cans out is also a violation of City of San Marcos code and you may be cited by the city. Contact the City of San Marcos Code Enforcement Hotline for more information or to report a violation at (760) 744-1050 ext. 3206.
